These Terms and Conditions ("Terms") govern your access to and use of the ShopLifter website, mobile application, and all related services (collectively, the "Platform") operated by ShopLifter ("ShopLifter," "we," "us," or "our"). These Terms form a legally binding agreement between you and ShopLifter.
ShopLifter is a curated sales discovery platform that aggregates publicly available sale and discount information from third-party department stores and retailers. We do not sell products directly. All purchases are completed on the respective retailer's own website or application.
1. Acceptance of Terms
By creating an account, accessing, browsing, or using any part of the Platform, you confirm that:
- You are at least 13 years of age (or the minimum age required in your jurisdiction to form a binding contract);
- If you are between 13 and 18, you have your parent or legal guardian's consent;
- You have read, understood, and agree to these Terms and our Privacy Policy;
- You have the legal capacity and authority to enter into these Terms;
- You are not barred from receiving services under applicable law.
We may modify these Terms at any time. When we make material changes we'll update the "Last Updated" date and, where appropriate, notify you in-app or by email. Continued use after a change means you accept the revised Terms.
2. Description of Service
2.1 What ShopLifter Does
ShopLifter aggregates sale, discount, and promotional information from participating and publicly indexed department stores including, but not limited to, Macy's, Kohl's, JCPenney, Nordstrom, Dillard's, Saks Fifth Avenue, Neiman Marcus, Bloomingdale's, and Boscov's (collectively, "Retail Partners"). We present this in a curated, personalized interface to help you discover deals that match your style and preferences.
- Aggregated deal and sales feeds, refreshed regularly;
- Personalized discovery based on mood, aesthetic, and saved preferences;
- An AI Style Concierge that suggests outfits across multiple stores;
- Smart Sizing filters across brands;
- Loyalty program info and store event listings;
- Wishlist and price-alert functionality;
- Direct links to third-party retailer pages for purchase.
2.2 What ShopLifter Does Not Do
- Sell, ship, or fulfill any product;
- Process or handle any payment transactions;
- Guarantee availability, accuracy, or current pricing;
- Act as an agent or partner of any Retail Partner;
- Provide professional styling or purchasing advice.
3. Affiliate Disclosure & Commercial Relationships
ShopLifter has or may have commercial relationships with Retail Partners and affiliate networks including, but not limited to, Skimlinks, Commission Junction (CJ Affiliate), Rakuten Advertising, ShareASale, and direct retailer affiliate programs. These relationships may include cost-per-click, cost-per-acquisition, sponsored placement, and data-sharing arrangements. The existence of an affiliate relationship does not affect the integrity of the information we display.
4. Price Accuracy & Product Information
4.1 Price Accuracy
Sale prices and offers shown on ShopLifter may differ from the retailer's site due to:
- Feed update delays (refresh intervals from near-real-time to ~30 minutes);
- Flash sales that expire before our feed updates;
- Regional pricing differences;
- Coupon or promo codes not reflected in base price;
- Retailer website errors or price corrections;
- Inventory changes affecting sale eligibility.
4.2 Product Availability
Items may sell out, be removed, or become ineligible for the displayed discount between the time we index them and the time you try to purchase. Always verify on the retailer's site before buying.
4.3 Product Descriptions & Images
Names, descriptions, and images come from Retail Partners and may contain inaccuracies. The retailer's product page is the authoritative source.
5. User Accounts
5.1 Account Creation
- Provide accurate, current, and complete information;
- Keep your password secure and confidential;
- Accept responsibility for all activity under your account;
- Notify us immediately at hello@shoplifter.deals of any suspected unauthorized access.
5.2 One Account Per Person
You may only create one account per person. Creating multiple accounts to circumvent suspensions or limits is prohibited.
5.3 Account Termination
We may suspend or terminate your account at any time, with or without notice, for any reason. You may request deletion at any time by emailing hello@shoplifter.deals.
6. Third-Party Loyalty Program Integration
If you connect a loyalty account (e.g., Nordy Club, Macy's Star Rewards, Kohl's Cash), you acknowledge that balances are estimates from third-party sources, ShopLifter is not affiliated with those programs, and we cannot redeem, transfer, or modify your points. Always verify with the retailer directly.
7. AI Style Concierge
The Style Concierge generates outfit suggestions algorithmically. Recommendations are not professional fashion advice, may include unavailable or repriced items, may include affiliate-linked products, and you retain full discretion over all purchases. Conversations may be stored to improve the feature, subject to our Privacy Policy.
8. Intellectual Property
8.1 ShopLifter's IP
The Platform — design, layout, graphics, logos, software, text, and the "ShopLifter" name and brand — is owned by or licensed to ShopLifter and protected by U.S. and international IP laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.
8.2 Third-Party Content
Product images, names, descriptions, and brand assets belong to their respective owners and are displayed pursuant to affiliate agreements, public data licenses, or fair use.
8.3 Your Content
If you submit content (reviews, style notes, feedback), you grant ShopLifter a non-exclusive, royalty-free, perpetual, worldwide license to use, display, reproduce, and distribute it in connection with operating and improving the Platform. You represent that you have the rights to grant this license.
9. Prohibited Conduct
You agree not to:
- Violate any law or regulation;
- Scrape, crawl, or systematically extract data without our written consent;
- Use bots, scripts, or tools to access the Platform or generate artificial traffic;
- Reverse engineer, decompile, or disassemble any part of the Platform;
- Circumvent or interfere with security features;
- Transmit viruses, malware, or other malicious code;
- Impersonate any person or entity;
- Harvest personal information about other users;
- Use the Platform for any unauthorized commercial purpose;
- Attempt to gain unauthorized access to any account, system, or network;
- Post unlawful, harmful, threatening, abusive, defamatory, or objectionable content.
10. Disclaimer of Warranties
To the fullest extent permitted by law, we disclaim all warranties including merchantability, fitness for a particular purpose, title, non-infringement, uninterrupted or error-free operation, accuracy of product or pricing data, and the suitability of AI-generated recommendations.
11. Limitation of Liability
This includes loss of profits, revenue, data, losses from price discrepancies, reliance on Style Concierge recommendations, unavailable products, third-party retailer errors, or unauthorized account access. In no event shall our total aggregate liability exceed the greater of (a) the amount you paid ShopLifter in the 12 months preceding the claim, or (b) one hundred dollars ($100 USD).
12. Indemnification
You agree to indemnify, defend, and hold harmless ShopLifter and its officers, directors, employees, agents, licensors, and service providers from any claims, liabilities, damages, judgments, losses, costs, and fees (including reasonable attorneys' fees) arising out of your use of the Platform, your violation of these Terms, your violation of any third party's rights, your submitted content, your violation of any law, or any transaction you enter into with a Retail Partner via a ShopLifter link.
13. Third-Party Links & Services
The Platform contains links to third-party websites. ShopLifter has no control over and assumes no responsibility for their content, privacy policies, or practices. Your access is at your own risk and subject to those sites' terms. Display of a Retail Partner does not constitute endorsement.
14. Privacy & Data
Your privacy is governed by our Privacy Policy, incorporated by reference. We collect information you provide (name, email, sizes, mood settings) to personalize your experience; behavioral data (views, saves, clicks) to improve recommendations; and may share anonymized, aggregated data with Retail Partners and analytics providers. We do not sell your personal data. You may request access, correction, or deletion at any time at hello@shoplifter.deals.
15. Cookies & Tracking
We use cookies, pixel tags, and similar technologies to operate the Platform, personalize your experience, measure performance, and deliver relevant content. You can control cookies via your browser settings, though disabling them may impair functionality.
16. Children's Privacy
ShopLifter is not directed to children under 13 and we do not knowingly collect personal information from them. If you believe we have, please contact hello@shoplifter.deals and we will delete it promptly.
17. DMCA & Copyright Notices
ShopLifter respects intellectual property rights. If you believe content on the Platform infringes your copyright, please send a written notice to our designated agent at hello@shoplifter.deals including: (a) your physical or electronic signature; (b) identification of the copyrighted work; (c) identification of the allegedly infringing material and its location on the Platform; (d) your contact information; (e) a statement of good-faith belief that the use is unauthorized; and (f) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the owner's behalf. We may remove allegedly infringing material and terminate repeat infringers.
18. Dispute Resolution & Arbitration
18.1 Informal Resolution
Before filing any formal proceeding, contact us at hello@shoplifter.deals and try to resolve the dispute informally. We will try to respond within 30 days.
18.2 Binding Arbitration
If informal resolution fails, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as otherwise provided. Arbitration will be conducted in our home state unless we agree otherwise.
18.3 30-Day Right to Opt Out
You may opt out of arbitration and the class action waiver by sending written notice to hello@shoplifter.deals within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you wish to opt out.
18.4 Exceptions
Either party may seek injunctive or other equitable relief in court to prevent infringement or misappropriation of intellectual property rights.
19. Governing Law & Venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration, you and ShopLifter consent to the exclusive jurisdiction of the state and federal courts located in Delaware.
20. Modifications to the Platform
We may, at any time and without notice, modify, suspend, or discontinue the Platform or any feature; add, remove, or change pricing; impose limits; or change the Retail Partners aggregated. ShopLifter shall not be liable to you or any third party for any such change.
21. Force Majeure
We are not liable for any delay or failure due to causes beyond our reasonable control, including acts of God, natural disasters, pandemic, war, terrorism, government action, internet outages, power failures, third-party service provider failures, or Retail Partner system outages.
22. Assignment
You may not assign or transfer these Terms or any rights without our prior written consent. We may freely assign these Terms, including in connection with a merger, acquisition, or sale of assets.
23. Accessibility
We strive to make ShopLifter accessible to people of all abilities. If you encounter a barrier, please contact hello@shoplifter.deals so we can address it.
24. California Residents (CCPA/CPRA)
California residents have certain rights regarding personal information, including the right to know what personal information we collect, the right to request deletion, the right to correct, the right to opt out of "sale" or "sharing," and the right not to be discriminated against for exercising these rights. To exercise any right, email hello@shoplifter.deals.
25. International Users & Export
ShopLifter is operated from the United States. If you access the Platform from outside the U.S., you do so on your own initiative and are responsible for compliance with local laws. You agree to comply with all applicable export control laws and not to export, re-export, or transfer the Platform to any prohibited person or destination.
26. Severability, Waiver & Entire Agreement
If any provision is found invalid, illegal, or unenforceable, it shall be modified to the minimum extent necessary to make it enforceable, or severed. No failure or delay in exercising any right is a waiver. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ShopLifter regarding the Platform and supersede all prior communications.
